«Якщо ВК має позитивну думку щодо реформи, то зобов’язана підтримувати владу в її ухваленні та просуванні»
Директор директорату з прав людини Генерального директорату з прав людини і верховенства права РЄ Кристос ДЖІАКУМОПУЛОС став почесним учасником конференції, присвяченої практиці застосування нового Кримінального процесуального кодексу. І хоча європейський високопосадовець брав участь у роботі відразу кількох секцій, а в перерві мав з’явитися ще й у прес-клубі МЗС, він люб’язно погодився відповісти на запитання кореспондентки «ЗіБ». К.Джіакумопулос розповів, зокрема, про те, як у РЄ оцінюють проект нового закону «Про прокуратуру» та зміни до Конституції, чому інші країни хотіли б мати такий же КПК, як український, і скільки років може зайняти процес реформування нашої правової системи.
«Ці зміни є передумовою для успішного завершення реформи кримінальної юстиції»
— Пане Джіакумопулос, як ви оцінюєте запропонований Президентом і попередньосхвалений Верховною Радою на початку жовтня проект змін до Конституції? Як ви вважаєте, чи буде він сприяти посиленню незалежності української судової системи, і якщо так, то яким чином?
— Що стосується змін до Конституції, запропонованих Президентом Віктором Януковичем, то, як ви знаєте, Венеціанська комісія дала їм позитивну оцінку. Позиція Ради Європи аналогічна. На мою думку, ці зміни дійсно є передумовою для успішного завершення реформи кримінальної юстиції, тому що вони дають великі гарантії незалежності судової системи. Це те, чого вже давно чекають від української влади: розширення таких гарантій і посилення правових основ незалежності судової системи і прокуратури. Запропоновані зміни до Конституції нарешті зроблять це можливим. Сподіваюся, що в результаті суди одержать більше можливостей для самоврядування, а втручання в правосуддя з боку політиків будуть мінімізовані.
— Напередодні голосування за запропонований Президентом проект змін до Конституції представники Венеціанської комісії та деяких інших європейських інституцій, зокрема ПАРЄ, закликали український парламент підтримати ці зміни. Проте опозиція заявила, що Європа на неї тисне. Як би ви прокоментували таку заяву?
— Ні Венеціанська комісія, ні Рада Європи, ні будь-яка інша європейська організація не можуть чинити тиск на українські інституції для ухвалення якого-небудь закону. Але якщо РЄ або її інститути, включно з Венеціанською комісією, вважають, що цей законопроект — важливий, прогресивний і відповідає європейським стандартам, покращує стандарти й функціонування демократичних інститутів в країні, то Рада Європи зобов’язана заявити про це й підтримати ухвалення закону. У цьому й полягає одна з функцій РЄ і ВК.
Якщо ВК має позитивну думку з приводу реформи, у неї теж є зобов’язання, я б навіть сказав — моральне зобов’язання, підтримувати владу в ухваленні закону та просуванні реформи. Це не повинно сприйматись як якийсь «розподіл» між опозицією та владою.
Позиція Ради Європи та її інституцій стосовно цих законів, реформ, змін до Конституції — та позиція, якої потрібно дотримуватись, оскільки цього чекають від країни — члена Ради Європи.
— Венеціанська комісія в цілому дала позитивну оцінку нового законопроекту «Про прокуратуру». У чому його прогресивність, наскільки документ відповідає європейським стандартам?
— Насправді законопроект «Про прокуратуру» — це документ, над яким Рада Європи й українська влада активно працювали разом понад рік. Тож текст, наданий Венеціанській комісії, — це результат спільної роботи й активних консультацій.
Експерти директорату з прав людини, котрі брали участь у цій конференції, також зробили свій внесок у роботу над підготовкою законопроекту про прокуратуру. Тому немає нічого дивовижного в тому, що він був позитивно оцінений — передусім як документ, так би мовити, котрий презентує принципові якісні зміни, якщо можна так висловитися, в усвідомленні ролі прокуратури й у цілому її діяльності в Україні. Вже було сказано (і це загальна позиція експертів з прав людини та Венеціанської комісії), що деякі аспекти все ще вимагають незначного вдосконалення. Наприклад, у проекті так і не скорочено деяких повноважень Генпрокурора, є питання, що стосуються незалежності прокуратури, дисциплінарних процедур і призначення прокурорів. Це ті ключові моменти, які Венеціанська комісія й експерти з прав людини визначили як проблематичні.
Ми не бачили законопроекту, поданого до парламенту, ми бачили тільки первинний текст документа, який оцінювала Венеціанська комісія. Проте я думаю, що після того, як ВК дала йому оцінку 13 жовтня 2013 року, деякі з вищезгаданих зауважень уже були враховані.
«Багато країн вважали б за краще мати такий же КПК, як ваш»
— Останніми роками українська правова система проходить серйозні випробування змінами: за цей час було прийнято низку ключових законів, що докорінно змінюють правила гри на юридичному полі, — закон «Про безоплатну правову допомогу», Кримінальний процесуальний кодекс. Скоро повинні бути ухвалені новий закон «Про прокуратуру» та зміни до Конституції. Як ви думаєте, чи готове ментально наше суспільство, і насамперед юристи — судді, адвокати, прокурори, до таких серйозних змін?
— Я думаю, тут усе якраз навпаки. Цих реформ чекають від України відтоді, як вона стала членом РЄ в 1995 році, і, звичайно, якась робота в даному напрямку велася. Ці реформи не почалися раптом, за помахом чарівної палички. І я думаю, що багато чого ще належить зробити після ухвалення згаданих законів, аби дані правові інструменти були відточені до досконалості, а нові інститути працювали так, як було передбачено. І це теж вимагає зміни ментальності, і, як ви правильно зауважили, ментальності не тільки юристів-професіоналів, а й суспільства в цілому. Але я впевнений, що це має відбуватися саме в такому порядку: спочатку — закони, потім — зміна свідомості, а не навпаки.
— Виходить, закони повинні змінити свідомість…
— Ми не можемо чекати, що свідомість зміниться без зміни законів. Так, я думаю, для того, щоб успішно пройшли реформи, Україні необхідно отримати відповідний правовий фундамент. Звичайно, це не означає, що реформи будуть успішними тільки тому, що у вас є правова база. Проте, якщо цієї бази немає, у вас взагалі не буде реформ і змін.
— Ви приїхали в Київ, щоб узяти участь у конференції, присвяченій імплементації нового КПК. Минув уже майже рік з того часу, як кодекс був прийнятий, і поки що більшість експертів відгукуються про нього позитивно. Що, на ваш погляд, може завадити його успішній імплементації?
— Поки що на конференції звучали тільки позитивні оцінки фахівців з приводу результатів імплементації нового КПК. Строк тримання під вартою під час попереднього слідства серйозно скоротився, стали активніше застосовуватися інші альтернативні запобіжні заходи — домашній арешт, застава. У цілому враження професіоналів, які працюють із кодексом, чи то прокурори, чи тосудді або адвокати, — досить позитивні.
Проте, як я вже говорив, ми тільки на початку процесу, потрібно буде прийняти ще багато законів, щоб побачити принципові всеосяжні зміни. Знадобиться вже згаданий новий закон «Про прокуратуру» (і перш за все великі гарантії незалежності), закон про бюро розслідувань, можливо, краще функціонування Національної асоціації адвокатів і приділення більшої уваги безоплатній правовій допомозі.
Заступник міністра юстиції пояснила, що це досить тривалий процес і тільки до 2017 року система безоплатної правової допомоги функціонуватиме так, як було передбачено спершу. Отже, ми на початку реформи, але перші результати вельми надихають.
Безумовно, я б не став говорити, що реформу завершено. Ми поки що не закінчили ні реформування правової бази, ні зміну свідомості. Все це ще попереду.
— А в чому головне принципове досягнення нового кодексу?
— Думаю, що головне принципове досягнення нового КПК — зменшення кількості осіб, котрих тримають під вартою. Якщо раніше обвинувачених брали під варту на етапі попереднього слідства майже автоматично, то тепер багато чого змінилося: судова система стала застосовувати альтернативні запобіжні заходи, а обвинувачені стали, здається, більше довіряти судам. Це доводить, що система, яка з’явилася завдяки новому КПК, працює досить ефективно.
Безумовно, дещо ще слід підкоригувати для того, щоб весь механізм працював ідеально. Але напрямок — правильний, і відгуки, які ми отримуємо від юристів-практиків, — непогані.
У будь-якому випадку, можу вас запевнити, що цей КПК — надзвичайно сучасний інструмент порівняно з аналогічними законами, які працюють в інших державах — членах РЄ. Думаю, багато хто із цих країн вважав би за краще мати такий же КПК, як ваш. Звичайно, порівнювані системи — це не одні тільки порівнювані закони. Як я говорив, це ще й ментальність, а також досвід, традиції, і все це ще повинно бути «побудовано».
— І скільки, на вашу думку, може зайняти такий процес «побудови»?
— Це дуже важко передбачити. Колись мені сказали, що зміна законодавства займає 1 рік, зміна принципу верховенства права — 10 років, а зміна свідомості — всі 25.
— Досить песимістичні перспективи для України…
— Це було сказано не стосовно України. Треба відзначити, що сьогодні ми не живемо в якійсь ізоляції, всі держави — члени Ради Європи та їхні правові системи взаємодіють, відбувається взаємне проникнення — за допомогою традицій, політики, співпраці тощо. Тому «зближення» правових систем нині відбувається набагато швидше, ніж у наведеному мною прикладі.

Interview with m-r Christos Giacumopulos
- M-r Giacumopulos, how do you assess the draft amendments to the Constitution of Ukraine, submitted by President of Ukraine Viktor Yanukovych, and which was approved in the first reading by Verkhovna Rada at the beginning of the October? Do you think it will be effective in terms of the strengthening of the independence of Ukrainian judiciary?
- As regards the Constitutional amendments that have been proposed by the President Victor Yanukovich as you know the Venice commission has been issued a quite positive assessment on that. The position of the Council of Europe in this question is the same. In my opinion these amendments is actually prerequisite for the sound implementation of overall criminal reform because they actually provide more guarantees for the independence of judiciary. That is something that is expected from the Ukrainian authorities: to increase these safeguards and to enhance the legal framework for the independence of the judiciary and the prosecutors. These changes will make it possible. Hopefully the judiciary can have an opportunity to gain more self governance and to diminish the interferences from the politicians.
- Before the voting for the Presidential amendments to the Constitution the representatives of the Venice Commission and other European institutions, in particular, PACE called on all political forces of the Ukrainian parliament to vote for these draft amendments in the proposed wording. After that the opposition party «Udar» accused Europe of putting pressure on the opposition. How would you comment this statement?
- Neither Venice commission, no the Council of Europe, nor any other European institutions can push the Ukrainian institutions to adopting the specific instrument. But when the council of Europe or its institutions including the Venice commission consider that the bill or draft is important, progressive, compatible and apt to the European standards, that it improves the standards and functioning of the democratic institutions in one country it has the obligation to say it and to favor the adoption of this law. This is what the Council of Europe is about and the Venice commission is about. So if the Venice commission has the positive opinion about the reform inevitably and necessarily it has the obligation, I would even say, the moral obligation to encourage the authorities to adopt this legislation and to follow this reform. This should not be perceived as «limitation» between the opposition and the authorities. The position of the CE and its institutions is the position that has to be followed with the compatibility of these laws, of these reforms, of these constitutional changes with what is expected from the member - state of the council of Europe.
- The legal opinion of the Venice Commission on the new draft law «On the Public Prosecutor's Office” was mostly positive. In your opinion, does this draft law is in line with the European standards concerning the operation of the Prosecutor’s office ?
- This draft law concerning the reform of the General prosecutors office is the law on which the Council of Europe and the Ukrainian authorities have been working together for more than 1 year very intensively. So the draft as it has been presented to the Venice commission is the result of the work that has been carried out together in active consultations. The experts from the Directorate of the Human rights that participate in this conference have been very much involved in the preparation of the draft law on the prosecutors service. So that's absolutely not a surprise that the law in principle was very positively assessed as a major qualitative change, if I may say so, in the perception and in the overall work of the Prosecution service in Ukraine. That's been said and that is a common position of the Human right experts and the Venice commission that there are some aspects of the law that still need to be fine-tuned. Some of the powers of the Prosecutor General still retains in the draft law and again some aspects are concerning the independence of the Prosecution service, concerning the disciplinary proceedings and the appointments of prosecutors. These are positions that the Venice commission and the human rights experts have identified as still being problematic. We have not seen the draft law that is about to be submitted to the Parliament, we have seen the initial draft that was assessed by the Venice commission. I believe that since the adoption of the legal opinion of the Venice commission on October 13-th until now some of these comments must have been taken into consideration.
- Ukrainian criminal justice system has been experiencing such crucial changes for the last year – the adoption of the CPC and the law «On legal aid», the introducing the new draft law on Prosecutors office etc. Do you think that our society and first of all our legal professionals (judges, prosecutors, defense lawyers) are mentally ready for these dramatic changes?
- I think it's the other way. These reforms are expected to be performed since the accession of the Ukraine to the CE in 1995, and, of course, there has been work on these reforms. They have not come by surprise. I believe that there is still a lot of work to be done after the adoption of these laws in order to these instruments, these laws, these new institutions to be fully operational and be implemented as required. And it also requires changing of mentality and as you rightly said not only of the legal professionals but also the society itself. But I believe that it must be this way that first is law and that the mentality will follow and not the other way.
- So the law must change the mentality…
- We can not expect the mentality to change without changing laws. Yes, I think that in order to have reform you need to have new legal framework. Of course, it does not mean that the reform will be successful only because you have the legal framework. But if you do not have legal framework you don't have reform and changes at all.
- It's been almost year since the new Criminal procedure code was adopted. What is in your opinion the principle problem that might prevent the successful implementation of the code?
- In the conference there has been so far very positive assessment from the legal professionals of the results of the implementation of the Criminal procedure code. Pretrial detention has been seriously decreased, other alternative restraints have been put into place – home arrest, bail. The overall impression that we get from the legal professionals – be it prosecutors or judges or defense lawyers - is rather positive. As I said before we are only at the beginning of the process, there are still a lot of other pieces of legislation are needed to be adopted in order to have comprehensive change and comprehensive reform. It requires the new law of prosecution, more guarantees of independence, it requires the law on the Bureau of investigation and perhaps better functioning of Barr association plus more emphasis on the legal aid. Today the deputy of ministry of justice explained that the process will take up to 2017 to be fully operational. So we are at the beginning of the face of the reform, the first resumes are encouraging. I would not go so far as to say that reforms are completed. We have not yet completed neither the change of the legal framework and certainly nor the change of the mentalities. This still remains to be done.
- What is the principle achievement of this CPC?
- I still believe that the principle achievement of the CPC is the reduction of the pretrial detention. The pretrial detention is no longer quasi automatic for any Ukrainian person that is accused and the justice system in Ukraine has found the alternatives and the accused people seem to trust the judicial authorities more than they did before. This shows that the system that was put in place by the CPC seems to work sufficiently. There still must be fine-tuned to work perfectly everywhere at the same time. But the direction is correct and the feedback that we receive from practitioners is okay.
In any case, I can assure you that it is extremely modern instrument comparing to other legislations that are already applicable in other members-states of CE. Many of them would prefer to have the legislation like this one. Of course, comparing systems is not only comparing legislations. As I said, it's an entire set of mentalities, and also experience, also traditions and all this takes to be built.
- And how long do you think it could take?
- That is difficult to say and to asses. You know, someone told me once that the reform of the legislation takes 1 year, the reform of the rule of law takes 10 years and the reform of the mentality takes 25 years…
- Rather pessimistic perspectives for Ukraine…
- It did not concern Ukraine. I must say that nowadays in Europe we don't live in isolation, all members-states of CE and their legal systems are interpenetrated by traditions, by policies, by cooperation, by exchanges, and therefore the approximation of the legal systems is much more rapid than mentioned in this historical example that I gave you. This actually goes back to the First world war. (laughing).
